Terms & Conditions
AREA OF APPLICATION:
These terms and conditions apply to all purchases from Residence Weinsepphof KG [https://www.sparklingrocco.com/impressum] that are made by private and business customers. Private customers and business customers in this sense are persons and companies with their registered-address and delivery address in the European Union.
PRICES AND SHIPPING COSTS:
The prices awarded are final prices including VAT. The amount that is shown at the time of the binding order, applies. In addition, the shipping costs, which depend on the shipping method, delivery address, size and weight of the goods you have ordered. The shipping costs are shown before the order is placed. The costs of the return, which arise in the event of a return of the goods by you in exercising your right of withdrawal, must be borne by the buyer. If you exercise your right of withdrawal, we will only refund the product costs.

RIGHT OF WITHDRAWAL:
Customers have the right to revoke this purchase contract within 5 days of arrival by stating reasons. The withdrawal period is 5 days from the day on which the customer or a third party named by you who is not the carrier has taken possession of the goods. In order to exercise your right of withdrawal, the customer must inform Residence Weinsepphof KG, based in Lana Feldgatterweg 19, Italy, by email [sparkling.rocco@outlook.com] of your decision to withdraw this purchase contract by sharing a clear statement .
If the customer cancels this contract, we will be reimbursing the amount paid for the products within the next 14 days after arrival of the returned goods. For the repayment, we use the same paymentmethod that customers used in the original transaction, unless something else was expressly agreed by the customer. The goods must be returned or handed over to us immediately and in any case not later than 7 days from the day the customer informed us of the cancellation of this contract. If possible, the customer should use the original packaging when returning the goods and accessories. The costs of returning the goods are borne by the customer. Customers only have to pay for any loss in value of the goods if the handling was not correct.

Payment can be made using the following payment options

DEFAULT OF PAYMENT:
If you are in default of payment, Residence Weinsepphof KG is entitled to demand interest on arrears at a rate of 5 percentage points above the base rate announced by the ECB for the time of the order. If Residence Weinsepphof KG demonstrably incurred higher damage caused by default, Residence Weinsepphof KG is entitled to assert this.

DELIVERY:
Delivery is made to the delivery address in Europe, specified by the customer when ordering. If force majeure (natural disasters, diseases, civil war, terrorist attack) makes delivery or any other service impossible, Residence Weinsepphof KG is not obliged to perform. In these cases already paid amounts will be refunded by Residence Weinsepphof KG.
The Residence Weinsepphof KG can also refuse the service if this requires an effort that is grossly disproportionate to the customer's interest in the fulfillment of the purchase contract. Residence Weinsepphof KG will refund any amounts which were already paid.
Bulky goods (pallet deliveries) are usually delivered by a forwarding agency. Residence Weinsepphof KG expressly points out that these goods are not transported into the house / warehouse.

DEFECT RIGHT:
A product that is already defective upon delivery (warranty case) will be replaced by a product free of defects or the purchase price will be refunded at the customer's option at the expense of Residence Weinsepphof KG. The customer's attention is drawn to the fact that there is no warranty case if the product had the agreed quality when the risk was passed. A warranty case does not exist in the following cases in particular:
1) in the event of damage caused by misuse or improper use by the customer,
2) in the event of damage caused by the customer's products being exposed to harmful external influences (in particular extreme temperatures and intense solar radiation)
Residence Weinsepphof KG's legal warranty ends two years from the date of production of the goods.

APPLICABLE LAW:
The contract concluded between you and Residence Weinsepphof KG is subject exclusively to EU law with the express exclusion of the UN sales law. This does not affect the mandatory provisions of the state in which you have your habitual residence.
